When inadequate security leads to personal injury

Home  |  Blog  |  When inadequate security leads to personal injury

Crimes can happen just about anywhere, but public spaces should not be hotbeds for criminal activity.

If you or a loved one was harmed due to inadequate security on commercial property such as a bar or a nightclub, you may have grounds for a personal injury or wrongful death claim against the property owner.

Unfortunately, criminal behavior is not uncommon in some bars, nightclubs, hotels, and stores across New Mexico.

When the owner of a bar, nightclub, hotel or store knows about a security risk on the premises but does nothing or not enough to protect guests, the owner may be liable for any injuries resulting on the dangerous premises.

For bars, nightclubs or hotels, examples of appropriate security measures include adequate lighting and locks, as well as appropriate action on the part of employees if a security threat becomes apparent. Failing to take these steps to protect guests can constitute negligence on the part of the property owner.

Additionally, over-serving of alcohol may be a factor, as assaults can become more likely when people in a bar or a nightclub become rowdy and intoxicated. The owners of these establishments have an obligation to stop serving a person who is obviously drunk and belligerent.

Bars, nightclubs or hotels are not the only places where people suffer injuries as a result of inadequate security.

You should be able to expect places that are open to the public to be reasonably safe. Places where security issues can pose a threat to your safety include:

  • Bars and nightclubs
  • Parking garages and lots
  • Movie theaters
  • Stores
  • Hotels
  • Apartments

Unfortunately, violent crimes such as robbery and assault can and do occur in these environments where people should be able to expect a reasonable degree of safety.

Not every personal injury law firm handles these kinds of cases.

The trial lawyers at Youngers Law have decades of experience in helping injury victims obtain the compensation they need and deserve. Such compensation may be for medical expenses and lost wages, as well as pain and suffering resulting from the incident.

We provide caring and competent representation for victims of crimes resulting from inadequate security.
